Justice Rehnquist's Cancer

News of Chief Justice Rehnquist's thyroid cancer focuses increased attention on the fact that whoever is elected will nominate our next Chief Justice and perhaps several associate justices. NYT is reporting that the Chief Justice's prognosis depends on the type of thyroid cancer, and the tracheotomy is just confusing things.

One of my colleagues has attempted to persuade me that Supreme Court nominations are the most important implication of this year's election (or should be for a law professor). While I am unconvinced of this proposition, I note this comment from Justice Breyer about Bush v. Gore:

"I had to ask myself would I vote the same way if the names were reversed," Breyer said Saturday at Stanford University Law School. "I said 'yes.' But I'll never know for sure - because people are great self-kidders - if I reached the truthful answer."
