A post-trial article in the WSJ reminded me of another distinguishing fact between the Scrushy trial and other trials where CEOs have been convicted: Scrushy didn't take the stand. Ebbers took the stand. Kozlowski took the stand. Quattrone took the stand. Interviews with jurors in all those cases revealed that the jurors did not believe the defendants. To become a top officer in a huge company, you have to have a large ego and a belief in yourself. It is hard as a defense attorney to convince a client like this that taking the stand is a bad idea. Try really hard.
