Enron & the Astros
Posted by Christine Hurt

At one time, although it seems like a lifetime ago, the Houston Astros played ball at a really cool place called Enron Field.  (And yes, before that they played in the 8th wonder of the world).  This week, Drayton McLane, owner of the Astros, took his base at the Enron trial to give character testimony about Ken Lay.  According to the Chronicle blog, McLane's testimony mainly centered on Lay's positive impact on philanthropy in Houston and on getting the Astros a new stadium.

The only interesting part of the questioning seemed to come at the end, when Lay's attorney, Chip Lewis passed the witness with this phrase:  "Please get Clemens, thank you."

I'm curious about the effectiveness of that comment. On the one hand, a juror might think, "Hey, this guy is down to earth, he's funny, and hey, go Astros!" But on the other hand, a juror might think, "His client might be sent up the river and all this guy cares about is the Astros?"

Matt, if you were a juror and thought the latter, would you be more inclined to help Lay up the river?

Well, it's an extremely minor issue, of course. But since every minute detail of these things is choreographed, the attorney had to have said it for effect. And as a juror, I would expect the defense to be very serious -- after all, the defendant's liberty is at stake. Any sense that the defense is not taking the trial seriously might feed into the perception that Lay & Skilling are arrogant and believe they are above the law. But then again, a juror might say, "Hey, this guy is down to earth enough that he can joke about the 'Stros, as opposed to those uptight prosecutors over there." So I'm curious as to how it actually played.

let's join our hands together to stop this kind of wrong doings. It may risk lives in the future if we just let them continue.
