Pitching

It’s been delightful to guest-stint on this here Conglomerate over the past fortnight. I’ve had a chance to weigh in on blog fortunes, corporate collapses, audio-scholarship, and law review practices. So what’s missing?

Oh yes – the pitch! I write about regulators, and, more generally, the ways they regulate when they want to avoid the constraints of the APA or other forms of supervision – say by suggesting “best practices” to regulateds instead of promulgating hard rules (my piece on which is forthcoming in the NYU L Rev and isn’t yet up on SSRN). Businesses can’t operate without knowing how their government supervisors act. If the wise business minded readers of this here website have views on the regulation nouvelle, please let me know.
