Steve Bainbridge just learned that he "lost out on a potential expert witness designation because [he] had written something negative about the prospective client" on his blog. Steve asks if this has happened to others. Probably, though I'm not sure how I would know. People ordinarily don't call me to tell me that they are not hiring me.

A couple of weeks ago, I gave a deposition and the topic of blogging came up during one of the breaks. It was obvious that the lawyers had become readers of Conglomerate. Looking for something that they might use, I suppose. Well, I don't blog about consulting gigs, but if I did, it would be the same as my other posts: truth from beginning to end. (The foregoing sentence was inspired by Stephen Colbert.)
