Open Access Publishing and the Future of Legal Scholarship

I am in Portland, Oregon for the conference Open Access Publishing and the Future of Legal Scholarship.  The paper I'm presenting focuses on the history of the legal information industry and the implication of current industry structure (particularly Lexis and Westlaw ("Wexis")) for questions of open access (you can also find a copy of my paper on SSRN).  Is open access publishing a viable means for disseminating legal scholarship?  What about other legal information?  Alternatively, is Wexis now so dominant that new entrants will likely be limited to niche players?
