Jones v. Harris decided -- unanimously.
Posted by William Birdthistle
A unanimous Supreme Court handed down its decision in Jones v. Harris this morning, reversing Chief Judge Easterbrook's notable Seventh Circuit ruling and reaffirming Gartenberg, with special emphasis on the comparison of institutional and retail rates. Justice Alito was the author of the remarkably brief 17-page opinion, and Justice Thomas penned a 2-page concurrence to take issue with the notion that the Court "endorsed" the Gartenberg standard. I would characterize this decision as a decidedly Gartenberg-plus ruling.
